Why Would I Need a Mediator?

Common cases that benefit from seeking the services of a mediator include Family Law, Estate Law, Real Estate Disputes, Business Law, Personal Injury, and Litigation.

Divorce

In the state of Utah, the courts require at least one session of mediation if there are contested issues after an answer is filed to a divorce complaint. This means that the two parties must try to resolve their dispute with mediation. If an agreement cannot be made, the divorcing couple may move forward with the court process. Extreme cases may be excused from mediation.

Family Law Disputes

Our law firm believes parents should be involved in shaping their child's life, so we mediate family law disputes like child custody, support, and visitation. This approach can help both parents maintain an active role in parenting. Additionally, mediation during divorce can be beneficial when children are involved as it can help you maintain a stable relationship with your ex.

Mediation may also be used in other non-criminal cases. To see if your legal dispute could benefit from mediation, contact our Ogden, UT, law firm.

Preparing for Mediation

If you want to give yourself the best chances of having a successful mediation session with our Utah mediator, there are some simple guidelines you can follow:

Identify Interests

Have a clear idea of your priorities and what you hope to gain from mediation. For example, a divorcing couple may prioritize time with their children, and business partners may wish to preserve their relationship in the long term. Try to reach a settlement that addresses these interests.

Be Realistic

Enter your mediation session with realistic expectations. Both parties have to be flexible and do their best to understand the other party's goals. You may not get everything you want, but you may be able to negotiate and find terms that are still favorable.

Have an Open Mind

During the mediation process, you may encounter facts and arguments you hadn't considered. Our Utah mediator recommends that clients be prepared for this, keep an open mind, and listen with respect.
